The current economic and financial crisis erupted several years ago. Its effects impacted deeply upon society, in which legal rules and social patterns have developed to enable the establishment of civilisation, justice and peace. Over time it has become more and more obvious that policy, financial and economic actors have adopted austerity measures as a main tool to solve the ensuing problems, and that these measures have hit social policy standards sometimes dramatically. Recent analyses have dealt with several aspects of this issue. This book focuses on one important element: the impact on collective labour law. It seeks to add to the debate by presenting mainly legal arguments derived from different sources and backgrounds, examining the EU and 'Troika' measures, the economic and political background and the sometimes dramatic consequences of austerity measures on democracy, collective bargaining and the right to strike. Against the framework of EU law, the relevant ILO Conventions, (Revised) European Social Charter and European Convention on Human Rights provisions, the non-compliance of these measures is analysed and demonstrated. The book is also dedicated to procedural questions, and in particular, how legal approaches may be used to challenge austerity measures.

The global economy is still struggling to emerge from the worst financial crisis and global recession since the Second World War. In this context, TUAC, ETUI, GURN and ITUC created a Task Force to define the parameters of a new growth model. This book is a follow-up to the ETUI 2012 volume 'The triumph of failed ideas'. The focus of the book is the weight attributed to the different economic and social development paths in ten individual EU countries, and their interaction with the austerity regime established at EU level which in fact is deepening the crisis rather than paving ways out of it. The most dangerous implication of this policy approach is, according to this study, that it is driving countries apart - misleadingly in the name of 'Europe', hence the title of the book 'divisive integration'. The main message of the book is that a gradual recovery is possible only if there is a change of course in individual countries that then triggers reactions in the policies of other countries and perturbations at the EU level. However, these changes in individual countries is no longer feasible without a green light or at least toleration from the level of the European institutions.

Is the Europe 2020 strategy leading us, as it promises, towards smart, sustainable and inclusive growth? This is the main question addressed by this publication on the eve of this year’s Spring European Summit. The ETUC and ETUI offer a critical assessment of the strategy and its various components: will it be able to provide a framework for the creation of more and better-quality jobs? Benchmarking Working Europe 2011 is structured in eight topical chapters illustrated by a significant number of graphs, and has a completely new layout. The various chapters on the different facets of Europe 2020 contain a carefully argued and critical analysis of the design and contents of the European mid-term strategy and of the state of the European economic, employment and social indicators. They question the underlying foundation which firmly places the emphasis on fiscal consolidation while neglecting the need for economic growth and quality jobs. The major problem is that, if the (macro) economics are wrong, all the other laudable targets and procedures in the Europe 2020 strategy – raising education standards and R&D spending, reducing poverty – will prove entirely illusory, further undermining the credibility of Europe. This book explores the foundations of the current economic crisis. Offering a heterodox approach to interpretation it examines the policies implemented before and during the crisis, and the main institutions that shaped the model of advanced economies, particularly in the last two decades. The first part of the book provides a theoretical analysis of the crisis. The roots of the ‘great recession’ are divided into fundamentals with origins in financial liberalisation, financial innovation and income distribution, and complementary or contributory factors such as the international imbalances, the monetary policy,and the role of credit rating agencies. Part II suggests various paths to recovery while emphasising that it will be necessary to develop alternative strategies for sustainable economic recovery and growth.
