La propiedad privada es el régimen más eficiente de explotación de recursos escasos, pero no siempre es posible porque su implantación está sujeta a costes que, en ocasiones, la hacen inviable. La disminución eficiente de tales costes es, por ello, requisito necesario para que pueda expandirse. A ello contribuye el desarrollo de tecnologías físicas, jurídicas y organizativas. Este trabajo tiene por objeto el estudio de algunas de estas tecnologías jurídicas, especialmente en materia de derechos de propiedad sobre bienes inmuebles. Para que la propiedad privada pueda cumplir su función eficientemente -estimular las inversiones a largo plazo y facilitar una asignación eficiente de recursos- se requiere una sofisticada ingeniería jurídica, pues en un entorno de contratación impersonal, como es el mercado, existe un inevitable trade off entre seguridad y liquidez de los derechos de propiedad, en el caso de que se mantenga la regla de reivindicabilidad ilimitada propia del Derecho común. La superación del citado trade off requiere, por ello, la derogación de dicha regla, lo que caracteriza al Derecho de la seguridad del tráfico jurídico. Ello implica la abstracción causal inter tertios , la cual produce la inversión de las reglas de protección de los iura in rem propia del Derecho común. Para que dicha inversión de las reglas de protección produzca el efecto deseado -la superación del trade off entre seguridad y liquidez de los derechos de propiedad-, son necesarios, sin embargo, requisitos adicionales. En el caso de los bienes muebles, basta con la atribución a la posesión de buena fe de una función legitimadora. En el caso de los bienes inmuebles, sin embargo, debido a sus especiales características, ello no es posible. Se requiere la intervención directa del Estado en el sistema transmisivo, es decir, una intervención no solo normativa -derogación de la regla de reivindicabilidad ilimitada- sino, también, institucional, mediante la introducción del Registro de derechos, el cual implica la publificación del sistema de transmisión de los derechos de propiedad sobre bienes inmuebles. El Derecho de la seguridad del tráfico jurídico, instrumentado en el ámbito inmobiliario mediante el Registro de derechos, consigue así superar el inevitable trade off entre seguridad y liquidez en un entorno de contratación impersonal gobernado por las reglas del Derecho común. En otros términos, consigue que los derechos sean, al propio tiempo, más líquidos y más seguros -y, por lo tanto, más valiosos- que en el Derecho Común.
