The Western Balkans have seen rapid changes since the end of the violent conflicts in the 1990s. The EU has been one of the main drivers for change, focusing on the political, economic and social transformation of the region to prepare the countries for membership in the Union. EU enlargement has never before been this complex and inter-connected with processes of state-building and democratization. It can be argued that the EU is actively involved in state-building. By focusing on a number of case-studies, it will be demonstrated how complex the transformation towards independent statehood and modern democratic governance has been (and continues to be) for most Western Balkan states. While some chapters focus explicitly on the role of the EU in these transformative procedures, others discuss the role of outside influences on state-building, democratization and independent governance more implicit. The picture painted is one of multiple and inter-connected alterations that have long-term consequences for the political systems of the region. This book investigates and explains the European Union’s approach to conflict resolution in three countries of the Western Balkans: Bosnia and Herzegovina, Macedonia and Kosovo. In doing so, it critically interrogates claims that the EU acts as an agent of conflict transformation in its engagement with conflict-affected states. The book argues, contrary to the assumptions of much of the existing literature, that rather than seeking the transformation of conflicts, the EU pursues a more conservative strategy based on the regulation of conflict through the promotion of institutional mechanisms such as consociational power sharing and decentralisation. Drawing on discourse analysis of documents, speeches, and interviews conducted by the author with European Union officials and policy-makers in Brussels and the case-study countries, the book offers a theoretically grounded, methodologically rigorous and empirically detailed analysis of EU policy preferences, of the ideas that underpin them, and of how those preferences are legitimised. Today, more than fifteen years after the end of the wars that accompanied Yugoslavia's dissolution, the "Balkan question" remains more than ever a "European question". In the eyes of many Europeans in the 1990s, Bosnia was the symbol of a collective failure, while Kosovo later became a catalyst for an emerging Common Foreign and Security Policy (CFSP). In the last decade, however, the overall thrust of the EU's Balkans policy has moved from an agenda dominated by security issues related to the war and its legacies to one focused on the perspective of the Western Balkan states' accession to the European Union. This Chaillot Paper, which features contributions from authors from various parts of the region, examines the current state of play in the countries of the Western Balkans with regard to EU accession. It brings together both views from the Balkans states themselves and overarching thematic perspectives. For the first time the European Union has become involved in the formation of new nation-states that also aspire to become members of the Union. The EU's transformative power has proved effective in integrating established states; now it is confronted with the challenge of integrating new and sometimes contested states. Do EU institutions have an influence on the implementation of the rule of law in potential candidate countries and, if so, of what kind? During the compliance monitoring process related to the effective rule of law and democracy the EU Commission tests and criticizes the effectiveness of the judiciary and strengthens the rule of law in preparation for accession.
