Professor DuVivier reviewed dozens of syllabi for energy law courses and brought that review, as well as her more than 25 years of law teaching, to bear when creating this Energy Law Basics (ELB) book. Energy Law is not one body of law, and an energy practice may involve a wide variety of skills. Consequently, no two energy law courses cover the same body of material. In addition, energy law changes quickly, and course materials must be updated constantly for accuracy. ELB was designed with these drivers in mind. First, it is professor-friendly and allows maximum flexibility. Timelines and thumbnail chapters give students a reliable summary of the relevant technology and history of key energy topics. The 19 chapters in Sections I-III provide enough material for professors to assign approximately one per week over a 15-week semester if they choose to adopt ELB as their only textbook. Alternatively, ELB can be adopted to provide a framework for a course, which the professor then supplements with (1) some or all of the nine skills exercises in part IV of the book; (2) more in-depth readings or books on particular topics; (3) student reports and discussions on current hot topics or updates about energy news; or (4) student seminar paper presentations. Alternatively, because ELB chapters are easy to mix and match and can stand on their own, the book can be ideal for short courses or as a supplement to other textbooks. Recognizing the fast-changing nature of energy law, each thumbnail chapter contains "Sources & Resources" citations to materials related to the chapter and also a Lexis-Advance update link to help find more recent updated legal areas of discussion. DuVivier brings her teaching and her technical expertise as a geologist to this book, but no one and no book can cover everything. Professor DuVivier asked experts in particular topics to review and provide substantive input on topics, but the sole-author mechanism allows ELB to avoid inconsistencies and repetition sometimes seen in multi-authored texts. DuVivier's teaching has focused on simulations and practical applications, and the ABA now requires 6 credits of experiential education. The Fundamental Skills exercises in part IV of ELB can help meet the ABA requirements by allowing students hands-on opportunities to master the energy law subject matter while also honing skills that are transferable to any law practice.

The aim of this short text is simply to introduce a reader to this topic. It is intended for a global audience and rather than being restricted to potential energy law students of a particular country. It is also written for students of other disciplines such as geographers, social scientists and engineers. It should also be engaging to those in a variety of professional practices who want an accessible background to and overview of the subject. The text aims to outline the principles and central logic behind energy law. Therefore, readers from across the world should be able to use it as a guide to thinking about energy law in their own countries. A variety of examples from many different countries are included in the text and while examples and comparisons are mainly from the EU and US, they represent good examples of more advanced and innovative energy law. For those readers who seek further or more in-depth knowledge, this text will only serve as an introduction. However, a key focus of the book is to direct the reader where they to look for further information and within the book there are suggested extra readings, the key recommended journals to read and other sources of information based on institutions who publish further material in this area. The aim of the Energy Law: An Introduction is to introduce new readers to the developing area of energy law. The hope is that it provides an introduction to the legal challenges faced in the energy sector and the potential contribution of energy law to delivering a better world for future generations.

Despite bringing prosperity, industrialisation generally leads to increasing levels of pollution which has a detrimental impact on the environment. In response, legislation which seeks to control or prevent such impact has become common. Similarly, climate change and energy security have become major drivers for the regulatory regimes that have emerged in the energy field. Given the global or regional scope of many environmental problems, international cooperation is often necessary to ensure such legislation is effective. The EU and the UK have contributed to the development of the environmental and energy law regimes currently in force, spanning across international, transnational and national levels. At the same time, practical responses to environmental and energy problems have largely been the focus of engineers, scientists and other technical experts. Environmental & Energy Law attempts to bridge the knowledge gap between legal developments designed to achieve environmental and/or energy-related objectives and the practical, scientific and technical considerations applicable to the same environmental problems. In particular, it attempts to convey a broad range of topical issues in environmental and energy law, from climate and energy regulation, technology innovation and transfer, to pollution control, environmental governance and enforcement. In addition the book outlines key sector specific legal regimes (including water, waste and air quality management), focusing on issues or topics that are particularly relevant to both environmental and energy lawyers, and engineering, science and technology-oriented professionals and students. In this vein, the book guides the reader on some basic practical applications of the law within scientific, engineering and other practical settings. The book will be useful to all those working or studying in the environmental or energy arena, including law students, legal professionals, engineering and science students and professionals. By adopting a multi-disciplinary approach to environmental and energy law, the book embraces all readerships and helps to address the often thorny problem of communication between scientists, engineers, lawyers and policy-makers.

New book purchase includes complimentary digital access to the eBook. This casebook serves as a guide to energy law and policy for students who seek to practice in the field and anyone interested in better understanding this critical area of law. It introduces the key federal, state, and local government actors shaping energy issues and explores the multi-jurisdictional approach to energy regulation pervasive in the United States. The book explains the foundations of the laws and policies governing energy extraction, use, markets, and disposal. It covers how we make energy from renewable and non-renewable resources and examines the future of the energy sector in light of new technologies, market trends, emerging risks, and the need for greater equality. The authors use a systemic approach that allows for a deeper exploration of the linkages between the resources, technologies, law, policy, and markets that make up our core energy systems, including electricity and transportation. Energy Law and Policy contains cases, sample statutes and regulations, and pertinent excerpts from experts. These policy-oriented, often empirical materials offer the necessary building blocks for a public law course, particularly one covering a rapidly transitioning field. The book is organized into three parts that introduce students to the fundamental aspects of the energy sector, energy law, and the most pressing energy topics of the 21st century. The third edition expands and deepens coverage in important ways: Updated treatment of state and federal policy initiatives such as community solar, 100% clean energy laws, energy transition and energy markets. An entirely new chapter on how climate change risks and initiatives are shaping the energy sector, including domestic and international net zero energy goals and widespread adoption of electric vehicles. Integration of energy and environmental justice concerns throughout the book. Expanded discussion of energy leasing and extraction on private and federal lands, including solar, geothermal, and onshore and offshore wind energy, and the critical role of energy efficiency. In-depth coverage of new energy-related executive orders, regulations, and policy shifts since the start of the Biden Administration. Enhanced attention to controversial energy transport projects, including oil and natural gas pipelines, fossil fuel export terminals, and long-distance electric transmission lines.

Global energy is on the cusp of change, and it has become almost a truism that energy is in transition. But what does this notion mean exactly? This book explores the working hypothesis that, characteristically, the energy system requires a strategy of the international community of states to deliver sustainable energy to which all have access. This strategy is for establishing rules-based governance of the global energy value-cycle. The book has four substantive parts that bring together contributions of leading experts from academia and practice on the law, policy, and economics of energy. Part I, 'The prospects of energy transition', critically discusses the leading forecasts for energy and the strategies that resource-rich countries may adopt. Part II, 'Rules-based multilateral governance of the energy sector', details the development and sources of rules on energy. Part III, 'Competition and regulation in transboundary energy markets', discusses principal instruments of rules-based governance of energy. Part IV, 'Attracting investments and the challenges of multi-level governance', focuses on the critical governance of the right investments. This book is a flagship publication of the Centre for Energy, Petroleum and Mineral Law and Policy at the University of Dundee. It launches the Hart series 'Global Energy Law and Policy' and is edited by the series general editors Professors Peter D Cameron and Volker Roeben, and also Dr Xiaoyi Mu.
