La presente disertación partió de la necesidad de una mejor reflexión sobre los Derechos y Garantías Fundamentales de la Salud existentes en las legislaciones de Brasil y Argentina y las posibles tutelas jurídico-procesales para asegurar tales garantías, en la falta de cumplimiento por el poder público en sus respectivas esferas. Como corolario del Estado Social de Derecho, la tutela específica ejercida por el Poder Judicial surge como reflejo de la toma de consciencia de que el derecho procesual debe priorizar el cumplimiento de la obligación asumida como garantía de la efectuación de las políticas públicas, en el ámbito administrativo de cada esfera de poder. Es con esa perspectiva que se trato el derecho a la salud, porque es un derecho fundamental y humano, sin el cual no se realiza efectivamente la dignidad de la persona humana. La elección del tema ocurrió a raíz de nuestra actuación como Defensora Pública en el Estado de Tocantins, hace más de veintitrés años, donde, en diversas oportunidades nos deparamos con cuestiones por negativa del poder público del acceso a la asistencia médica y farmacéutica, internación, y del suministro de medicamentos etc. Los objetivos anhelados, consistieron en la demostración de las tutelas jurisdiccionales específicas de los derechos a la salud y a la concretización de las decisiones judiciales concesivas de las tutelas reclamadas. Se abordó la caracterización de la relación jurídica, Estado & ciudadanos, cuando se trata de la salud pública y privada. Se procuró a través del estudio bibliográfico, y en los sitios oficiales, demostrar el funcionamiento del sistema de Salud en Brasil y Argentina, la aplicabilidad de las normas de regencia y el respeto de la administración pública de ambos países. El método adoptado para la investigación fue el deductivo, por medio de investigación exploratoria en la doctrina y en la jurisprudencia, y también fue importante el análisis de casos concretos para la mejor comprensión de la problemática de la tutela específica del derecho a la salud, especialmente en lo que tañe al entendimiento y efectiva aplicación de los poderes concedidos a los magistrados por fuerza de los dispositivos legales y constitucionales. Se partió del estúdio del derecho a la salud como derecho fundamental social de que se constituyen en verdaderos derechos públicos subjetivos que le permiten al ciudadano-creedor, exigir del Estado-deudor, prestaciones materiales de asistencia a la salud. Del mismo modo, por ser derecho fundamental, también encuentra amplia protección de la tutela de los usuarios de planes y seguros de salud, cuya relación obligacional genera un vínculo que obliga al proveedor a cumplir la promesa de prestar la debida asistencia médico-hospitalaria al consumidor. Esto ocurre porque tanto en Brasil como en Argentina se aplican los dispositivos de defensa del consumidor. Fue posible constatar que a pesar de que los sistemas procesales de Brasil y de Argentina, colocan a disposición del jurisdiccionado, diversos procedimientos que pueden ser usados en la protección del derecho a la salud, sea del punto de vista de las acciones individuales, sea en lo que se refiere a las acciones colectivas, las tutelas específicas es que se muestran aptas para las obligaciones de hacer consistentes en la prestación de asistencia a la salud, tanto en el ámbito del servicio público como en el privado gracias a legislaciones Internacionales, Constitucionales e infra-constitucionales.
