In the early summer of 2005, an international expert meeting was convened in The Hague to share and compare national experiences with conciliation and mediation as methods for resolving collective labor disputes. Both the European Union and the Council of Europe have committed themselves to promoting these methods which aim to assist disputants in finding creative, negotiated solutions, while preserving their long-standing relationships. Ideally, trade unions and employers (associations) have such long-standing relationships, and many European countries have specialized conciliation officers or mediation services operating in this area. The meeting allowed leading mediators and academics to share their experiences and to exchange their views on the changes permeating Europe today: the rise of transnational labor disputes, the decentralization of collective bargaining, the process of de-unification, the joining of the EU by new member states without a social dialogue tradition, and the insights generated by the emerging science of principled bargaining, facilitative mediation, and conflict management. All these developments are likely to increase the demand for expert mediation services assisting more often less experienced negotiators. Thereby, the very nature of mediation may gradually change. This book documents the proceedings and provides a comprehensive overview of EU initiatives in the field of collective labor law and dispute resolution.

Peronism, the Argentine political movement created by Juan Perón in the 1940's, has revolved since its inception around a personalistic leader, a set of powerful trade unions, and a weakly institutionalized political party. This book examines why Peronism continued to be weakly institutionalized as a party after Perón was overthrown in 1955 and argues that this weakness has impeded the consolidation of Argentine democracy. Within an analysis of Peronism from 1943 to 1995, the author pays special attention to the 1962-66 and 1984-88 periods, when some Peronist politicians and union leaders tried, but failed, to strengthen the party structure. By identifying the forces that led to these efforts of party-building and by analyzing the counterforces that thwarted them, he shows how these failures have shaped Argentina's experience with democracy. Drawing on this interpretation of Peronism and its place in Argentine politics, the book develops a distributive conflict/political party explanation for Argentina's democratic instability and contrasts it to alternatives that stress economic dependency, populist economic policies, political culture, and military interventionism.

This edition of the Inter-American Yearbook on Human Rights , like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion & protection of human rights. It begins with the composition of the Commission & Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions & reports by the Commission & historic correspondences & decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly.
