To date, there have been few theoretical inquiries into the relationship between the technological innovation and basic objectives of consumer protection laws. This book addresses this need by considering the impact of technological innovation on the foundations of consumer advocacy, contracting behaviour, control over intellectual capital and information privacy. The collection presents a unique and timely perspective on these issues. The authors, internationally renowned experts, from diverse areas such as consumer issues in technology markets, contract, and intellectual property provide a fresh perspective on these topics. Contributions provide novel approaches to the question of what consumer protection might consist of in the context of technological innovation. The book will be a valuable resource to academics and researchers in law and public policy and is easily accessible to graduate and undergraduate students working in these areas.

The sustainability goals and the circular economy have been high on the list of priorities of the EU and its Member States over the past few years. In Slovenia, they have found their way into the Constitution and into the key strategic national documents, including the Slovenian Development Strategy 2030 and the Roadmap for the Transition to the Circular Economy. Though consumers play a crucial role as enablers of the circular economy, there has been tension between the sustainability aims and aims of consumer law, which are not always aligned. As provided by the EU's Circular Economy Package, '[t]he choices made by millions of consumers can support or hamper the circular economy'. The integration of environmental policy into consumer law is pursued through regulation on the supply and on demand side of the market, i.e. it is aimed at stimulating sustainable production and consumption. While the traditional consumer law paradigm envisages balancing of interests of consumers as the weaker parties on the one hand and businesses on the other, sustainability can be one aspect that is weighed in this balancing exercise, and thus contributes to the paradigm shift in accordance with horizontal clauses found in Articles 11 TFEU (environmental protection) and Articles 12 TFEU (consumer protection), as well as in accordance with Articles 37 and 38 of the EU Charter of Fundamental Rights, respectively. This contribution will assess whether and how sustainability goals and the circular economy are internalized in consumer law and policy in Slovenia, with an emphasis on civil law rights and obligations.

The implementation of the circular economy will entail a major transformation from a resource-destroying, linear economy to a circular one that operates within the planet’s regenerative boundaries. This book presents an interim assessment of the implementation of a circular economy in the EU. It reveals what achievements have been made in various EU institutions, but which are scarcely perceived by the public; which basic scientific principles can be applied in this context; and what NGOs are demanding beyond this progress. It provides convincing arguments for abandoning the “hamster wheel” of material-based satisfaction of our needs, and shows that the primacy of the economy stands in the way of a good life for all. Given its focus, it will appeal to everyone interested in an ecologically sustainable economic system.

This book reflects the research output of the Committee on the International Protection of Consumers of the International Law Association (ILA). The Committee was created in 2008, with a mandate to study the role of public and private law to protect consumers, review UN Guidelines, and to model laws, international treaties and national legislations concerning protection and consumer redress. It has been accepted to act as an observer not only when the UNCTAD was updating its guidelines, but also at the Hague Conference on Private International Law. The book includes the contributions of various Committee members in the past few years and is a result of the cooperation between the Committee members and experts from Australia, Brazil, Canada and China. It is divided into three parts: the first part addresses trends and challenges in international protection of consumers, while the second part focuses on financial crises and consumer protection and the third part examines national and regional consumer law issues.

The book explores the role of public market actors in sustainable and circular economy innovation and financing. The shift to a circular economy requires active innovation, alongside radical changes in law, finance and policy considerations, since regulation is often tightly connected with the assumption of a linear model of consumption. Finance is crucial in creating sustainable and circular economy markets and innovations: public finance is important from the perspective of seeing the state as an engine for promoting sustainable innovations, but private funds are also required. Legislative initiatives for promoting repairs have been proposed or adopted in the EU, US and in Australia, representing remarkable steps forward but still leaving many obstacles without legislative intervention. This book examines circular economy regulation and policy on a comprehensive, general level, as well as assessing the regulatory possibilities of promoting the right to repair. Promotion of circular economy innovations as well as changing the practices and changing consumer patterns towards a more comprehensive adoption of CE are discussed from perspectives of legal, social and moral norms. The book critically evaluates current legislative reforms and assesses existing barriers to the circular economy and innovation in intellectual property law, consumer law and competition law. Providing an in-depth analysis of this dynamic field, geared towards reconsidering both existing and prospective policies and regulatory regime, the book makes recommendations for solutions to legislative barriers. It is an indispensable resource for both researchers and practitioners working at the intersections of markets, innovations and sustainability.
