This volume focuses on how, in Europe, the debate on the commons is discussed in regard to historical and contemporary dimensions, critically referencing the work of Elinor Ostrom. It also explores from the perspective of new institutional political ecology (NIPE) how Europe directly and indirectly affected and affects the commons globally. Most of the research on the management of commons pool resources is limited to dealing with one of two topics: either the interaction between local participatory governance and development of institutions for commons management, or a political- economy approach that focuses on global change as it is related to the increasingly globalised expansion of capitalist modes of production, consumption and societal reproduction. This volume bridges the two, addressing how global players affect the commons worldwide and how they relate to responses emerging from within the commons in a global- local (glocal) world. Authors from a range of academic disciplines present research findings on recent developments on the commons, including: historical insights; new innovations for participatory institutions building in Europe or several types of commons grabbing, especially in Africa related to European investments; and restrictions on the management of commons at the international level. Across the globe, political movements opposing privatisation, enclosures, and other spatial controls are coalescing towards the idea of the ‘commons’. As a result, struggles over the commons and common life are now coming to the forefront of both political activism and scholarly enquiry. This book advances academic debates concerning the spatialities of the commons and draws out the diverse materialities, temporalities, and experiences of practices of commoning. 'Global Commons’ refers to resource domains or areas that lie outside of the political reach of any one State, including sea areas beyond national jurisdiction and Antarctica. The concept of ‘global commons’ is a living concept and can accommodate, over time, other commons at the international level, such as biodiversity and generic resources. The outlook for the global marine commons is not encouraging: fishery resources continue to deplete, marine biodiversity continues to reduce, and plastic wastes in the oceans continue to increase. In international law, there are legal regimes governing global marine commons, the most important of which is the 1982 United Nations Convention on the Law of the Sea (LOSC). Effective as of 1994 LOSC governs the high seas, international seabed and its resources, marine environmental protection, and fisheries. Global Commons and the Law of the Sea offers intellectual discussions on global marine commons. It contains six parts respectively addressing the principle of the common heritage of mankind (CHM), freedoms of high seas, deep sea mining and international seabed, area beyond national jurisdiction (ABNJ) governance, management of geoengineering and generic resources, and recent developments in the polar regions.

This book provides a unique analysis of the complex relationship between governance and the global commons.
