An eligible person or bus. may file a protest challenging a Fed. contract award or the procedure by which the offers were solicited. This report reviews the cases, particularly small business (SB) cases, that have been filed in district courts and U.S. Court of Fed. Claims (COFC) (Courts) since the Admin. Dispute Resolution Act of 1996 took effect. The report's objectives are to: identify the # of bid protest cases filed in the Courts between 1997 and 1999, that were filed by SB, the type of agencies involved, and the amount of the procurement; identify the perceived advantages and disadvantages, particularly for SB, of filing bid protest cases in each judicial forum.

This edition incorporates changes made to GAO¿s Bid Protest Regulations, effective June 9, 2008, to conform the regulations to changes in GAO¿s jurisdiction enacted by section 568 of the Dept. of Homeland Security Appropriations Act, 2008, and by sections 326 and 843 of the National Defense Authorization Act for FY 2008. This edition also incorporates changes to GAO¿s protective order.

The Boeing Co. protested the award of a contract to Northrop Grumman Systems Corp. by the Dept. of the Air Force for KC-X aerial refueling tankers. Boeing challenged the Air Force¿s technical and cost evaluations, conduct of discussions, and source selection decision. Because Boeing competed for the contract, it is an interested party for purposes of filing a protest. Under the Competition in Contracting Act of 1984, the government is required to consider protests of contract awards filed by interested parties. In deciding protests, the Congress makes a determination of whether the agency¿s actions complied with procurement status and regulations. Includes recommendations. Charts and tables.
