Excerpt from Bar Examinations (New York) And Courses of Law Study It will serve no purpose to explain or justify the changes. They were asked for by the profession and granted by the Court, and it will be sufficient to call them generally to the attention of those who seek admission to the Bar in New York on examination. No changes have been made in the preliminary educational qualifications. It is still the rule that no person can begin the study of the law unless he is eighteen years of age, and has earned a law student's certificate or is a graduate of a college or university. Concerning the particulars of both of those latter requirements application should be made to the Commissioner of Education, Capitol, Albany, N. Y. Excerpt from A Compilaton of the Bar Examination Questions of the State of New York, Since 1896 To Students: The authenticity of these questions is not guaranteed, because the Examining Board has never made an official publication; but they are offered to you in the belief, founded on what was deemed credible information, that they are the same questions that have been propounded at the New York bar examinations in the past five years. It is believed that you will derive greater benfit from the study of them than can be had from publications of "test questions" devised by the authors and designed for general use, because: 1. They acquaint you with the nature of the task before you. 2. They give you a review of the law of New York. In studying them, however, keep in mind the following injunctions: Do not expect to find any of them at your examination. Notice how few repetitions there are. It is a poor board of examiners that cannot think of new questions. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from New York Bar Examination Questions and Answers Q.A, an infant, is the owner of a certain piece of land. He authorizes B, an adult, to sell said land. B conveys the same to C.After A became of age, it is claimed that he ratified the conveyance. A sues in ejectment. Can he recover? A. Judgment for A. The question here is, can an infant after arriving at age, ratify the act of his agent performed while he was an infant? This depends upon whether his appointment of an agent is a void or voidable act. If the former, it cannot be ratified; if the latter, it can be. In New York the doctrine is laid down, that the only act an infant is incapable of performing as to contracts is the appointment of an agent or attorney. Whether the doctrine is founded upon solid reasons may be doubted, but there is no doubt that it is law. Fonda v.Van Horn, 15 Wend.631. Q.A appoints B, an infant, as his agent to sell certain goods. B sells the goods to C.A afterwards seeks to disaffirm the sale, and brings action to recover back the goods on the ground that B's act was void, as an infant cannot be an agent. Judgment for whom and why? A. Judgment for C. "It is by no means necessary for a person to be sui juris, or capable of acting in his or her own right, in order to qualify himself or herself to act for others." Excerpt from Summary of the Law of Evidence in the State of New York and Bar Examination While this little pamphlet has been prepared with a view to its general usefulness to students preparing for the New York State Bar Examinations, I feel that a word of explanation as to its primary purpose is necessary. The first part, which is a brief and concise summary, or, rather, classification, of the law of evidence in the State of New York, was prepared by me for use in connection with the Bar Examination quiz classes which I conduct from time to time for the New York Bar Examinations. For this reason it is but a skeleton of the various rules of evidence, and is intended only as an aid to the student, so that he may properly classify the rules of evidence, and in a sense visualize the extent of the field to be covered. Citations have been added only in those cases where the subject is fully reviewed by some leading authority or where some recent modification of the law has been made. The tendency of the Bar examiners in this State to obtain a great deal of the material for their examinations from decisions appearing for the most part in the Advance Sheets and in recently published volumes of the official reports, has made it worth while to prepare in question and answer form a large number of very interesting recent cases, which may profitably be used not only in preparation for the Bar examinations, but also as an independent means of keeping up with the law. Unlike some other reproductions of classic texts (1) We have not used OCR(Optical Character Recognition), as this leads to bad quality books with introduced typos. (2) In books where there are images such as portraits, maps, sketches etc We have endeavoured to keep the quality of these images, so they represent accurately the original artefact. Although occasionally there may be certain imperfections with these old texts, we feel they deserve to be made available for future generations to enjoy.
