This book collects Professor Atle Grahl-Madsen's essays on refugee law and policy in a single volume, including commentary on the principles of refugee law and on important refugee crisis situations. Arranged in chronological order, the compilation of work contains all the author's scholarly English language articles dedicated to the needs and rights of refugees and asylum seekers. The republication of these articles makes an important part of Atle Grahl-Madsen's written work more easily accessible than before. The objective of the book is to provide a new perspective on Grahl-Madsen's approach, his ideas and the results of his research and thinking. As the United Nations High Commissioner for Refugees, Mrs Sadako Ogata, has stated in the foreword: `The timelessness of Professor Grahl-Madsen's writings stems from his conscientious and comprehensive research and his clarity of thought as an analyst His dedication and precision should serve as both an inspiration and aspiration to all who work to defend the rights of the displaced.' The collection shows the extent and quality of Atle Grahl-Madsen's legacy in the field of refugee law and human rights, and demonstrates the diversity of the subject of international refugee law and its relevance to the world in which we live.

This Commentary provides the first comprehensive legal article-by-article analysis of the provisions of the Convention on the Rights of Persons with Disabilities (CRPD). The Convention is the key international human rights instrument exclusively devoted to persons with disabilities and the centerpiece of international efforts to address inequalities and barriers they encounter to the full enjoyment of human rights. The book discusses the Convention’s position within existing international human rights law and within the framework of the United Nations measures to protect the rights of people with disabilities. Starting with the background of all the Convention’s articles, including the travaux préparatoires, this Commentary examines each provision’s substance and interpretation, and explores the significance of each right, its legal scope and relationship with other international legal norms and principles. A unique contribution also analyzes the Optional Protocol to the Convention. In addition to enriching academic studies of international human rights law, the book provides insights into the practical operation of the Convention’s provisions by assessing the practice of the CRPD Committee, the activities of relevant international and regional human rights bodies in enforcing the rights of persons with disabilities and the contracting parties’ implementation practices. Relevant European Court of Human Rights, the Court of Justice of the European Union and, if appropriate, other regional jurisdictions’ case law, as well as the jurisprudence of domestic courts, are taken into consideration. Contributions from leading scholars and international experts make this book an indispensable resource for lawyers, academics, students, journalists, international organizations, NGOs and other stakeholders wanting to better understand the rights of people with disabilities. Furthermore, it makes a valuable contribution to appraising the impact of the Convention in the legal orders of contracting parties and to charting the way forward in the protection of the rights of persons with disabilities.

This title was first published in 2000: An ethnographic inquiry into the socio-cultural dynamics of the Vietnamese asylum seeker detention centres in Hong Kong during the period of 1988-1995. It deals essentially with the British asylum policy towards Vietnamese refugees and its outcome in Hong Kong. Based on the author's first hand experience of working in refugee camps, this book argues that the administrators managed to solve the crisis by perpetuating horrendous human rights violations and subsequent ethnocide of the asylum seekers trapped in the detention centres.

Whilst immigration policy is a highly controversial topic in the West, states continue to receive people who settle, whether as asylum-seekers or refugees, or as family members of existing migrants or labour migrants. Many who move violate the immigration rules either in entering a country or staying beyond the time allowed. The problems illegality entails for migrants shape much of the law and society scholarship in this area and this volume brings together the key articles which shape current thinking. The main topics covered include illegality, mercy and the language of deservingness; transnationality; family and identity; refugees and asylum-seekers.
