In this report the Treasury Committee argues that governance at the Bank of England must be strengthened to reflect its new powers. The Court of the Bank of England should be transformed into a smaller, more expert Supervisory Board with its own staff. It should decide on the allocation of resources among the Bank's different areas of work and its minutes should be published. The Supervisory Board should have the power to conduct and publish retrospective reviews of Bank policies and conduct. The Board should also have a statutory responsibility to respond to reasonable requests for information from Parliament. The Chancellor should be responsible and accountable in a period of financial turbulence where public money is at risk, and in these circumstances the Chancellor should be given a temporary and limited power to direct the Bank. The Committee proposes a means by which this can be achieved without requiring the use of the 'nuclear weapon' of the 1946 Act, which would undermine Bank of England independence across the board. Other recommendations include: the Governor should be appointed for a single, non-renewable term of 8 years; thorough parliamentary scrutiny of the new macro-prudential tools to be given to the FPC at the time of their introduction; the Treasury should give guidance to the FPC that it adopt published indicators for defining and gauging financial stability; the Financial Policy Committee (FPC) and the Monetary Policy Committee (MPC) should have a majority of external members.

In this report the Treasury Committee calls on the Independent Commission on Banking to address a number of concerns that have been raised about its proposal to ring-fence retail banking - including its effect on the competitiveness of UK banking and the cost of credit to business. The Commission should also look at how corporate governance in banks could be improved to enhance the stability of the financial system. The MPs urge the major banks to place any objections or concerns they have about the ICB proposals fully in to the public domain. A final ICB report based on private discussion and agreement with the banks rather than rigorous public scrutiny would lack public credibility and acceptability. The Committee is also concerned that the option of full structural separation of retail and investment banking has not received sufficient analysis. The ICB should provide further details as to the costs and benefits of this reform option and why it decided against full separation when proposing ring-fencing as the lead option in its interim report.

This report identified serious concerns in a number of areas, including: unacceptable difficulties contacting HMRC by phone during peak periods; endemic delays in responding to post; and an increasing focus on online communication that may exclude those without reliable internet access. The Committee recognises that the Department performs a crucial role and operates under significant external pressures including continuing resource reductions, deficiencies in tax legislation and the legacy of the merger. It also acknowledges the commitment of management to tackling these problems and the dedication and professionalism of HMRC staff. However, it concluded that the Department has a difficult few years ahead of it, as it attempts to improve its service. The Committee makes recommendations in the following areas: Improving the service provided by contact centres; providing robust alternative to online contact; ensuring greater awareness of the impact of process changes on individuals and businesses; ensuring reductions in resources are managed in a way that is commensurate with the enabling IT and process improvements and minimises the loss of Departmental tax expertise; reviewing the division of responsibilities between HMRC and HM Treasury in relation to making tax policy, to ensure practical considerations are taken into account at the earliest possible stage; better targeting of letters that threaten serious consequences against individuals; having the National Audit Office externally audit preparations for Real-time Information, to ensure Ministers can be held accountable for progress against the Government's ambitious timetable; and examining how the Department can achieve better accountability around the settlement of large tax cases

There has been little analysis of the constitutional framework for management of the UK economy, either in constitutional law or regulatory studies. This is in contrast to many other countries where the concept of an 'economic constitution' is well established, as it is in the law of the European Union. Given the extensive role of the state in attempting to resolve recent financial crises in the UK and elsewhere in Europe, it is particularly important to develop such an analysis. This book sets out different meanings of an economic constitution, and applies them to key areas of economic management, including taxation and public borrowing, the management of public spending, (including the Spending Review), monetary policy, financial services regulation, industrial policy (including state shareholdings) and government contracting. It analyses the key institutions involved such as the Treasury and the Bank of England, also including a number of less well-known bodies such as the Office for Budget Responsibility. It thus provides an account of the public law applying to economic management in the UK.
