Nine studies are being conducted - one for each federal, state, and territory jurisdiction. This report presents the findings for Western Australia. It describes the legal and operational context of the current system and reports the current and future issues identified by judicial officers and other key stakeholders. In Western Australia, the children's court deals with juvenile justice and child welfare matters.

The Children’s Court is one of society’s most important social institutions. At the same time, it is steeped in controversy. This is in large measure due to the persistence and complexity of the problems with which it deals, namely, juvenile crime and child abuse and neglect. Despite the importance of the Children’s Court as a means of holding young people accountable for their anti-social behaviour and parents for the care of their children, it has not been the subject of close study. Certainly it has not been previously studied nationally. This book, an edited collection, is based on the findings of study that spanned the six States and two Territories of Australia. The study sought to examine the current challenges faced by the Children’s Court and to identify desirable and feasible directions for reform in each State and Territory. A further unique feature of this study is that it canvassed the views of judges and magistrates who preside over this court.

Canvassing the socio-legal context for youth detention in Australia with a focus on international human rights law and legal frameworks within Australian states and territories, this book examines the recurring children’s rights-violations of recent years, and puts forward strategies for reform. Providing a comprehensive national picture of juvenile detention legislation, policy and practices using a children’s rights framework, this book is a detailed synthesis of investigatory reports, judicial decisions and inquiries by both Royal Commissions and parliamentary committee inquiries that together establish an evidence base for assessing the compliance of youth detention with Australia’s international and domestic human rights obligations. It also proposes nine pillars for reform to help Australia move towards children’s rights compliance. A Children’s Rights Assessment of Juvenile Detention in Australia provides an invaluable resource for policy-makers, lawyers and criminologists, as well as for students of law and criminology.

Following on from the Columbus case management pilot conducted in 2001-2002, Case Assessment Conferences (CACs) were introduced in the Family Court of Western Australia in July 2004 to promote client-focussed, collaborative, interdisciplinary case management and to include risk screening and assessment as a central element in the process. A total of two hours was allowed for each CAC and covered three phases: screening and assessment, negotiation, and the procedural hearing, which incorporated the ability to make Consent Orders without a further court attendance. This evaluation report assesses the CAC process as: 1) an early intervention and screening case assessment procedure focused on achieving best outcomes for children; 2) a referral procedure that identified the practical and emotional obstructions to reaching agreement and recommended strategies to assist parties in finding resolutions to their disputes; and 3) a case management system that reduces litigation and time taken and increases client satisfaction. The evaluation study involved a comparison of cases before and after the introduction of CAC and interviews with participating parents, legal practitioners, and Court personnel. This report presents the findings and recommendations of the evaluation.

This handbook engages key debates in Australian and New Zealand criminology over the last 50 years. In six sections, containing 56 original chapters, leading researchers and practitioners investigate topics such as the history of criminology; crime and justice data; law reform; gangs; youth crime; violent, white collar and rural crime; cybercrime; terrorism; sentencing; Indigenous courts; child witnesses and children of prisoners; police complaints processes; gun laws; alcohol policies; and criminal profiling. Key sections highlight criminological theory and, crucially, Indigenous issues and perspectives on criminal justice. Contributors examine the implications of past and current trends in official data collection, crime policy, and academic investigation to build up an understanding of under-researched and emerging problem areas for future research. An authoritative and comprehensive text, this handbook constitutes a long-awaited and necessary resource for dedicated academics, public policy analysts, and university students.
