This case study of transportation policy for disabled people illustrates the flaws in policymaking that lead many Americans to believe government is not working as it should. Robert A. Katzmann examines the workings of the legislative, administrative, and judicial processes, both separately and in interaction, as he relates the erratic path of transportation policy for the disabled over two decades. An estimated 13.4 million people in this country have difficulty using public transportation, but the federal response to their problems of mobility is of fairly recent vintage, beginning with legislation in the early 1970s. Since then, there have been many twists and turns in policy, involving a wide array of governmental institutions. These constant shifts have confused state and local governments, the transit industry, and the disabled community. Assessing why policy was so erratic, Katzmann concludes that in part the confusion resulted from the inability to choose between conflicting approaches to the problem--one oriented toward the rights of equal access for the disabled, and the other favoring effective mobility by any practical means. In addition, the conflict between these two policy approaches was compounded by increasing fragmentation within and among national institutions.

"TRB's Transit Cooperative Research Program (TCRP) Synthesis 74: Policies and Practices for Effectively and Efficiently Meeting ADA Paratransit Demand highlights policies and practices that transit agencies may be able to apply to their own paratransit services, often without the need to devote significant funds, personnel, or other resources. The report also examines certain practices and technologies that are still under development or have not undergone extensive testing"--Publisher's description.

The objective of this project is to provide a perspective on the most recent Federal Civil Rights Legislation - the Americans with Disabilities Act (ADA) - and how it affects non-urban public transportation in Kansas. The first step toward making public transportation fully available to all Americans is to make all transportation systems fully accessible. This report will supplement and serve as an index to the myriad of existing technical assistance documents, pamphlets, checklists, manuals, and guidelines which are available to help individuals and organizations comply with ADA. It also demonstrates how information can be gathered from the 1990 census on characteristics of the population with regard to disabilities and the impact on public transportation. Sample maps and charts are displayed and discussed. Recommendations are made concerning the examination of ADA and its impact on public transportation. An extensive bibliography of available documents is provided.

TRB's Transit Cooperative Research Program Legal Research Digest 11: Potential Tort Liability for Transit Agencies Arising Out of the Americans with Disabilities Act presents an assessment of problems in implementing the Americans with Disabilities Act (ADA), Public Law 101- 336, enacted in 1990, from the perspective of transit operators. The report should be helpful to transit operators, administrators, planners, risk managers, and attorneys in devising a transit program that meets the objective of the act, minimizes risk of harm to disabled passengers, and ultimately minimizes the transit operators' potential for tort liability. It is organized as follows: Introduction; (I) Requirements of the ADA and Predecessor Federal Laws Governing Accessible Transportation; (II) Survey - Impact of the Americans with Disabilities Act on Tort Liability; (III) Requirements Imposed on Transit Operators by the Americans with Disabilities Act (ADA); (IV) Waivers and Other Remedial Strategies; Appendix A - Survey Questionnaire; Appendix B - Responses to Survey Tables; and Appendix C - Seattle Metro Letter to U.S. DOT.
