"The Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) requires the Regional Fishery Management Councils and NOAA Fisheries Service to prevent overfishing while achieving optimum yield (OY) from each fishery. When it is determined a stock is undergoing overfishing, measures must be implemented to end overfishing. In cases where stocks are overfished, the Councils and NOAA Fisheries Service must implement rebuilding plans. The most recent assessment for the red snapper stock in the South Atlantic indicates that the stock is experiencing overfishing and is overfished (SEDAR 15 2008). A new benchmark assessment for red snapper is scheduled to be completed in December 2010. The purpose of Snapper Grouper FMP Amendment 17A is threefold: (1) to implement management measures to end overfishing of the red snapper stock in the South Atlantic immediately upon implementation; (2) to rebuild the stock so it may ultimately produce optimum yield (OY); and (3) to minimize to the extent practicable adverse social and economic effects expected from the first two items"--Abstract (p. iv).

"Regulatory Amendment 13 to the Snapper Grouper FMP (Regulatory Amendment 13) revises the ABCs, ACLs (including sector ACLs), and ACTs for select un-assessed species in the snapper grouper FMU, and reflects the intent of the South Atlantic Council. Updates will include data through 2008 since that was the last year used in the Comprehensive ACL Amendment to establish ACLs. Additionally, species in the snapper grouper FMU with stock assessments (including those in Amendments 17A and 17B to the Snapper Grouper FMP); species with ABC=0 landings; and those species not utilizing a formula to calculate their ABC in the Comprehensive ACL Amendment are excluded from Regulatory Amendment 13. The proposed action in Regulatory Amendment 10 is an elimination of a snapper-grouper area closure approved in Amendment 17A to the Fishery Management Plan for the Snapper-Grouper Fishery of the South Atlantic Region (Amendment 17A). This final rule establishes an annual catch limit (ACL) of zero for red snapper, which means all harvest and possession of red snapper in or from the South Atlantic exclusive economic zone (EEZ) is prohibited, and for a vessel with a Federal commercial or charter vessel/headboat permit for South Atlantic snapper-grouper, harvest and possession of red snapper is prohibited in or from State or Federal waters. This rule also implements an area closure for South Atlantic snapper-grouper that extends from southern Georgia to northern Florida where harvest and possession of all snapper-grouper species is prohibited (except when fishing with black sea bass pots or spearfishing gear for species other than red snapper), and requires the use of non-stainless steel circle hooks when fishing for snapper-grouper species with hook and line gear north of 28° N. latitude in the South Atlantic EEZ. "At their August 2011 meeting, the South Atlantic Fishery Management Council approved Regulatory Amendment 11 for review by the Secretary of Commerce by a unanimous vote. The proposed action in Regulatory Amendment 11 is the elimination of a possession prohibition for six deepwater snapper-grouper species (snowy grouper, blueline tilefish, yellowedge grouper, misty grouper, queen snapper, and silk snapper) harvested in depths greater than 240 feet (40 fathoms) in the South Atlantic EEZ. The closure was implemented on January 31, 2011, through Amendment 17B to the Fishery Management Plan for the Snapper-Grouper Fishery of the South Atlantic Region (Amendment 17B). The purpose of the harvest prohibition approved in Amendment 17B is to reduce discards of speckled hind and warsaw grouper. However, there is evidence, from both public comments and new analysis of data, that the prohibition is not effective at its stated purpose and comes at a higher economic cost to fishermen than originally anticipated. A new analysis of landings data following the implementation of the prohibition indicates that different measures would be more appropriate to reduce discards of speckled hind and warsaw grouper than those implemented through Amendment 17B. Therefore, the Council has developed Regulatory Amendment 11 to remove the harvest prohibition implemented through Amendment 178.
