Excerpt from A Treatise on the Law of Insurance Although I have not hesitated to express my opinions and rea sons without reserve, and without, at the same time, testifying my respect for those from whom I have differed, not thinking that the occasion required any declaration of this sort; yet I have not thought it necessary, iii all cases, to state what I understood to be the law. In many instances, the diverse opinions of judges, and of writers, are given without any comment, or any intima tion in regard to the preponderance of authority or reasons, in favour of either side of a questio'n. It would doubtless have been more prudent, on my part, and perhaps not less acceptable to my readers, had I more frequently pursued this course. A Treatise on Insurances

A Treatise on Insurances
Author: Balthazard-Marie Emerigon
Publisher: The Lawbook Exchange, Ltd.
Total Pages: 812
Release: 2005
Genre: Insurance
ISBN: 1584775378

Originally published in 1783, Emerigon's learned treatise was praised by James Kent, who said it "very far" surpassed "all preceding works in the extent, value, and practical application of his principles. It is the most didactic, learned, and finished product extant on the subject. (...) In the language of Lord Tenterdon, no subject in Emerigon is discussed without being exhausted, and the eulogy is as just as it is splendid." Meredith's able translation is complemented by a brief biography of the author and a chronology of the book's compilation. Emerigon [1716-1785] was the leading French authority on commercial law during the eighteenth and early nineteenth centuries. His work was held in the highest regard by English and American jurists. Excerpt from A Treatise on the Law of Fire Insurance The author has endeavored in the following work to systematize the principles deducible from the nu'merous decisions of our courts upon the complex subject of fire insurance, and thus exhibit, in convenient form, the present state of that branch of the law. In going over such an extensive field of inquiry, he cannot flatter himself that he has been so fortunate as entirely to avoid error and mistake. And he would be grateful to his professional brethren, if, in following his footsteps, they would point out to him any defects they may chance to discover in the way, so that he may be able, in any future edition, to correct them.
