Anthropology of Law in Muslim Sudan analyses the hybridity of law systems and the plurality of legal practices in rural and urban contexts of contemporary Sudan, shedding light on the complex relation between Islam and society. It is the outcome of the international research program ANDROMAQUE (Anthropologie du Droit dans les Mondes Musulmans Africains et Asiatiques), funded by the French ANR (Agence National de la Recherche) between 2011 and 2014. Crossing two disciplinary perspectives, anthropology and law, the present volume contains original fieldwork data on contemporary urban and rural Sudan. Focusing on two major domains, land property and courts, several case studies demonstrate the relevance of an approach based on “legal practices” to underline, first, the plurality and hybridity of law systems and the relative role of the Islamic reference in Sudanese society, and, secondly, the reshaping of legal behaviors and norms after the breaking point of South Sudan's independence in 2011. Muslim Arab Sudanese in Cairo have played a fundamental role in Egyptian history and society during many centuries of close relations between Egypt and Sudan. Although the government and official press describes them as "brothers" in a united Nile Valley, recent political developments in Egypt have underscored the precarious legal status of Sudanese in Cairo. Neither citizens nor foreigners, they are in an uncertain position, created in part through an unusual ethnic discourse which does not draw principally on obvious characteristics of difference. This rich ethnographic study shows instead that Sudanese ethnic identity is created from deeply held social values, especially those concerning gender and propriety, shared by Sudanese and Egyptian communities. The resulting ethnic identity is ambiguous and flexible, allowing Sudanese to voice their frustrations and make claims for their own uniqueness while acknowledging the identity that they share with the dominant Egyptian community.

A merchant’s remarkable travel account of an African kingdom Muḥammad al-Tūnisī (d. 1274/1857) belonged to a family of Tunisian merchants trading with Egypt and what is now Sudan. Al-Tūnisī was raised in Cairo and a graduate of al-Azhar. In 1803, at the age of fourteen, al-Tūnisī set off for the Sultanate of Darfur, where his father had decamped ten years earlier. He followed the Forty Days Road, was reunited with his father, and eventually took over the management of the considerable estates granted to his father by the sultan of Darfur. In Darfur is al-Tūnisī’s remarkable account of his ten-year sojourn in this independent state, featuring descriptions of the geography of the region, the customs of Darfur’s petty kings, court life and the clothing of its rulers, marriage customs, eunuchs, illnesses, food, hunting, animals, currencies, plants, magic, divination, and dances. In Darfur combines literature, history, ethnography, linguistics, and travel adventure, and most unusually for its time, includes fifty-two illustrations, all drawn by the author. In Darfur is a rare example of an Arab description of an African society on the eve of Western colonization and vividly evokes a world in which travel was untrammeled by bureaucracy, borders were fluid, and startling coincidences appear almost mundane. Black Morocco: A History of Slavery, Race, and Islam chronicles the experiences, identity and achievements of enslaved black people in Morocco from the sixteenth century to the beginning of the twentieth century. Chouki El Hamel argues that we cannot rely solely on Islamic ideology as the key to explain social relations and particularly the history of black slavery in the Muslim world, for this viewpoint yields an inaccurate historical record of the people, institutions and social practices of slavery in Northwest Africa. El Hamel focuses on black Moroccans' collective experience beginning with their enslavement to serve as the loyal army of the Sultan Isma'il. By the time the Sultan died in 1727, they had become a political force, making and unmaking rulers well into the nineteenth century. The emphasis on the political history of the black army is augmented by a close examination of the continuity of black Moroccan identity through the musical and cultural practices of the Gnawa.
